1. Acceptance of Terms

By accessing, reading, or otherwise using any content published on The Metabolic Archives (”Publication”), whether through Substack or any other platform or medium, you (”Reader”) acknowledge that you have read, understood, and agree to be bound by these Terms of Use (”Terms”). If you do not agree to these Terms in their entirety, you must immediately cease accessing the Publication.

Your continued access to or use of the Publication following notice of any modification to these Terms constitutes your acceptance of the modified Terms.

2. Publication Identity and Operator

The Metabolic Archives is owned and operated by a Carlos A. Arche, M.D., licensed physician duly licensed to practice medicine in the State of Texas (”Operator”). All content is created and published in the State of Texas. These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

3. Purpose and Scope of the Publication

The Metabolic Archives is an educational publication dedicated to providing broad, accessible information about metabolic medicine and related topics to a general, non-medically trained audience. All content is intended solely for general educational and informational purposes.

The Publication does not provide, and is not intended to provide, medical advice, clinical guidance, diagnosis, treatment recommendations, or any other form of professional medical service.

No content published in The Metabolic Archives, including but not limited to blog posts, articles, guides, newsletters, comments, or any other materials, constitutes or creates a physician-patient relationship between the Operator and any Reader.

4. No Medical Advice — Important Notice

The information contained in The Metabolic Archives is not a substitute for professional medical advice, diagnosis, or treatment. Never disregard, delay seeking, or abandon any professional medical advice or prescribed treatment on the basis of anything you read in this Publication.

The Operator will not respond to any request for individualized medical opinions, diagnoses, or treatment recommendations. Any such request, whether submitted through comments, replies, direct messages, or any other channel, will be directed to the Reader’s own physician or qualified healthcare provider.

5. Intellectual Property and Ownership

5.1 Ownership

All content published in The Metabolic Archives, including but not limited to articles, blog posts, guides, newsletters, text, graphics, images, formatting, selection and arrangement of content, and all other materials (collectively, “Content”), is the exclusive intellectual property of the Operator and is protected under the copyright laws of the United States of America and the State of Texas.

The Publication displays the following copyright notice: © 2026 The Metabolic Archives. All rights reserved. This notice applies to all Content published in the Publication, regardless of the date of publication.

5.2 No Implied License

Nothing in these Terms, and nothing arising from your access to or use of the Publication, shall be construed as granting any license, right, or permission to use, copy, reproduce, distribute, transmit, publish, modify, create derivative works from, or otherwise exploit any Content, whether express, implied, or by estoppel, except as expressly stated in Section 5.3 below.

5.3 Strictly Prohibited Uses

All reproduction, redistribution, republication, or use of the Content — in whole or in part, in any form or medium, for any purpose — is strictly prohibited without the prior explicit written consent of the Operator. This prohibition applies without limitation to:

  • Reproducing or redistributing Content on any website, blog, newsletter, social media platform, or publication;

  • Incorporating Content, in whole or in part, into any medical, clinical, educational, commercial, or institutional materials;

  • Using Content as the basis for any medical decision-making, clinical protocol, patient communication, or treatment guidance;

  • Copying, scraping, or harvesting Content by automated or manual means for any purpose;

  • Translating, summarizing, or creating derivative works based on the Content without authorization;

  • Distributing Content in any form to third parties without prior written consent.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES arising from or related to: (a) any Reader’s reliance on, use of, or inability to use any Content; (b) any medical decision made or action taken based on Content published in the Publication; (c) any unauthorized reproduction, redistribution, or use of Content by any third party; or (d) any error, omission, or inaccuracy in the Content.

The Operator makes no warranty, express or implied, regarding the accuracy, completeness, timeliness, or fitness for any particular purpose of the Content. Medical knowledge evolves continuously; Content published in The Metabolic Archives reflects information available at the time of publication and may not reflect subsequent developments.

Any Reader who relies on the Content for any clinical, diagnostic, or treatment purpose does so entirely at their own risk and expressly assumes all liability arising therefrom.

7. Indemnification

You agree to indemnify, defend, and hold harmless the Operator from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Content in violation of these Terms; (b) any unauthorized reproduction or redistribution of the Content by you or any party acting at your direction; or (c) any clinical or medical use of the Content by you or any third party to whom you have redistributed the Content.

8. Copyright Enforcement

The Operator actively enforces its intellectual property rights. Unauthorized reproduction or redistribution of Content may constitute copyright infringement under Title 17 of the United States Code and may subject the violating party to civil liability, including statutory damages, actual damages, and attorneys’ fees, as well as injunctive relief.

The Operator reserves the right to pursue all available legal remedies against any individual or entity that reproduces, redistributes, or otherwise uses the Content without explicit written authorization.

If you become aware of any unauthorized use of Content from The Metabolic Archives, please report it through the Publication’s official contact channel on Substack.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any choice of law or conflict of law provisions. Any dispute arising under or relating to these Terms or the Content shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Texas, and you hereby consent to personal jurisdiction in such courts.

10. Modifications to These Terms

The Operator reserves the right to modify these Terms at any time. Modifications will be effective upon publication of the revised Terms on the Publication. The “Last Revised” date at the top of this document will be updated accordingly. Your continued use of the Publication following any modification constitutes your acceptance of the revised Terms.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the remaining provisions, which shall continue in full force and effect.

12. Entire Agreement

These Terms, together with the medical disclaimer published on each post, constitute the entire agreement between you and the Operator with respect to your use of the Publication and supersede all prior agreements, understandings, and representations.
